This website is operated by Skyla Rose Co (trading as skylaroseco, ABN 33 832 761 120). Throughout the site, the terms "we", "us" and "our" refer to Skyla Rose Co. We offer this website, including all information, tools and services available from it (including our Fitting Room virtual try-on), to you, the user, on the condition that you accept these Terms of Service ("Terms") and the policies referred to in them, including our Privacy Policy, Returns Policy and Shipping Policy.

By visiting our site and/or purchasing from us, you agree to be bound by these Terms. If you do not agree, please do not use the website. Any new features or tools added to the store are also subject to these Terms. Our store is hosted on Shopify.

1. Online store terms

By agreeing to these Terms, you confirm that you are at least the age of majority where you live, or that you are the age of majority and have given consent for any of your minor dependants to use this site under your supervision. You may not use our products or this site for any illegal or unauthorised purpose, and you must not transmit any viruses or code of a destructive nature. A breach of these Terms may result in your access to the site being ended.

2. General conditions

We may refuse service to anyone for any reason at any time, subject to applicable law. You understand that your content (not including card information, which is always encrypted) may be transferred over various networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the site or service without our written permission.

3. Accuracy of information

We work hard to keep information on this site accurate and current, but it is provided for general information only. We may update the site at any time, but we have no obligation to update any information except as required by law.

4. Changes to products and prices

Prices and products are subject to change without notice. We may modify or discontinue any part of the site or service at any time.

5. Products

Some products may be available only online and in limited quantities, and can be returned or exchanged only in line with our Returns Policy. We have made every effort to display product colours and images as accurately as possible, but we cannot guarantee that your screen will display colours accurately, and each production batch may vary slightly in colour. We may limit sales of any product to any person, region or jurisdiction, and may discontinue any product at any time.

6. Orders, billing and account information

We may refuse or cancel any order, or limit quantities per person, household or order, including orders that appear to be placed by resellers. If we change or cancel an order, we will try to notify you using the contact details you gave us. You agree to provide current, complete and accurate purchase and account information.

7. Fitting Room (virtual try-on)

Our Fitting Room lets you upload or take a photo and see an AI-generated preview of how selected garments may look. By using the Fitting Room, you agree that:

  • you will only upload a photo of yourself, and you are 18 or over; or, for children's garments, you are the parent or legal guardian of the child pictured and consent to their photo being used for the try-on;
  • you will not upload photos of any other person, or any photo that is unlawful, offensive, explicit or that you do not have the right to use;
  • try-on images and videos are AI-generated previews for styling purposes only. They may not exactly reflect a garment's fit, size, colour, fabric or drape, and are not a guarantee of how a product will look or fit. Size suggestions are a guide only;
  • try-on images are for your personal, non-commercial use; and
  • the Fitting Room is provided with the help of our AI technology partner. Your photos are not kept or stored by us and all images are deleted by our partner within 72 hours, as explained in our Privacy Policy.

We may change, suspend or remove the Fitting Room at any time. Your rights to return or exchange products are set out in our Returns Policy and are not changed by any try-on result.

8. Optional and third-party tools

We may give you access to third-party tools and services (for example payment, buy now pay later, shipping protection and returns services). These are provided "as is", and your use of them is at your own discretion and subject to the third party's own terms.

9. Third-party links

Links on this site may take you to websites that are not operated by us. We are not responsible for their content, products or practices, so please review their policies before engaging with them.

10. Comments, reviews and other submissions

If you send us reviews, comments, photos, ideas or other materials, you agree that we may use, edit, publish and share them in any medium without compensation. You agree that your submissions will not breach anyone's rights or contain unlawful, abusive or obscene material, and that you are responsible for them. We may remove any content we consider unlawful, offensive or in breach of these Terms.

11. Personal information

Your personal information is handled in line with our Privacy Policy.

12. Errors and omissions

Occasionally the site may contain errors or omissions, for example in product descriptions, pricing, promotions, shipping charges or availability. We may correct any errors and change or cancel orders affected by them, including after an order has been placed.

13. Prohibited uses

You must not use the site or its content: for any unlawful purpose; to infringe our or anyone else's intellectual property; to harass, abuse, defame or discriminate against anyone; to submit false or misleading information; to upload viruses or malicious code; to collect or track other people's personal information; to spam, phish, scrape or crawl the site; for any obscene or immoral purpose; or to interfere with the site's security features.

14. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

15. Disclaimer and limitation of liability

Subject to section 14, we do not guarantee that the site or any service will be uninterrupted, timely, secure or error-free, or that results from using it (including Fitting Room results) will be accurate or reliable. To the maximum extent permitted by law, the site and services are provided "as is" and "as available", and we are not liable for any indirect, incidental or consequential loss arising from your use of the site or any product. Where our liability cannot be excluded but can be limited, it is limited (at our option) to resupplying the goods or services or paying the cost of having them resupplied.

16. Indemnity

To the extent permitted by law, you agree to indemnify us against any claim or demand made by a third party arising out of your breach of these Terms or your violation of any law or the rights of a third party.

17. Severability and termination

If any part of these Terms is found to be unenforceable, the rest will continue to apply. These Terms apply until ended by you or us. You may end them at any time by no longer using the site. We may end them, or deny you access to the site, if we reasonably believe you have breached them.

18. Entire agreement

These Terms and the policies referred to in them are the entire agreement between you and us about your use of the site, and replace any earlier versions.

19. Governing law

These Terms are governed by the laws of New South Wales, Australia.

20. Changes to these Terms

We may update these Terms from time to time by posting changes on this page. Your continued use of the site after changes are posted means you accept them.
